1. Eligibility: Clarks Every Shoe Tells a Story (the “Competition”) is open to residents worldwide who are at least eighteen (18) years old at the time of entry, and who are not employees of Clarks, McCann, Yellow Door, Wildfire Interactive Inc., and any of their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Competition is subject to all applicable English and local laws and regulations. Void where prohibited. This competition is not open to individuals who reside in a country embargoed by the United States.

2. Sponsor & Administrator: Clarks, 40 High Street, Street, Somerset, BA16 0EQ, England.

3. Agreement to Official Rules: By participating in the Competition, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all matters related to the Competition. Whether an entrant receives a prize is contingent upon fulfilling all requirements set forth herein.

4. Timing: The Competition begins on September 8, 2010 at 09:00 a.m. Greenwich Mean Time (“GMT”), ends on October 25, 2010 at 09:00a.m. GMT (the “Competition Period”) and consists of three (3) phases as set forth below:

Submission: September 8, 2010 @ 09:00 GMT to October 18, 2010 @ 23:59 GMT Any submissions after this date will not be entered.

Public Voting: September 8, 2010 @ 09:00 GMT to October 18, 2010 @ 23:59 GMT

Judging: September 8, 2010 to October 25, 2010

Administrator’s computer is the official time-keeping device for the Competition.

5. How to Enter: During the Submission Phase, visit the Application and follow the links and instructions to register and upload a photograph of you and your shoes, with a caption (up to 50 words). Limit: Each entrant can enter once during the Submission Phase. By completing the registration and submitting your Photo, you agree that your Photo conforms to the Photo Guidelines and Content Restrictions, as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor, in its sole discretion, may remove your Photo and disqualify you from the Competition if it believes, in its sole discretion, that your Photo fails to conform to the Guidelines and Restrictions.

Competition Guidelines:
-The Photo must be completely original and created by entrant.
-The Photo must include at least one shoe.
-Entrants must obtain express permission from any person whose likeness is visible in any photograph submitted to the competition, prior to submission. Under 18s must not appear in submitted photographs without express permission from the parents or legal guardians of said child.

Content Restrictions:
• The Photo must not violate or infringe another’s rights, including but not limited to intellectual property rights, or that constitutes copyright infringement.
• The Photo must not contain material that is inappropriate, indecent, obscene hateful, tortuous, defamatory, slanderous or libelous.
• The Photo must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age
• The Photo must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any territory where the Photo is created.

For all Entries: Sponsor may in its sole discretion disqualify entries for which intellectual property claims are received and remove any such entry or component thereof from the website. Sponsor reserves the right to eliminate any entry that does not adhere to the Entry Guidelines or the terms and conditions of these Official Rules, uses inflammatory or derogatory language, or that is lewd, obscene, pornographic or disparages Sponsor, or that are otherwise inappropriate at Sponsor’s sole discretion, and any such entry may be disqualified and not posted to (or removed from) the website.

All Photos will become the exclusive property of Sponsor, and none will be acknowledged or returned. Sponsor shall have the right to edit, adapt and publish any or all of the Photos, and may use them in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity. SUBMITTING A PHOTO IN THIS COMPETITION CONSTITUTES ENTRANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANSFERENCE TO SPONSOR OF ANY AND ALL RIGHT, TITLE AND INTEREST IN THE PHOTO INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. Sponsor and Administrator are not responsible for lost, late, incomplete, invalid, un-intelligible or misdirected Photos, which are disqualified.

All of Sponsor’s decisions are final.

6. Winner Determination: Winners will be determined via the process set forth below.

Judging Phase (Weekly Prizes): During the Judging Phase, judges (including an independent judge) determined by Sponsor in its sole discretion will select up to 7 winners per week. Winners will be announced on a weekly basis or once a response has been received by the Sponsor, from the winner, acknowledging the email informing them that they have won. Public votes will not be counted for Weekly Prizes.

Voting Phase (Grand Prize): During the Voting Phase, the Finalists will be posted on facebook.com/clarks.shoes. Members of the general public will be invited to vote for their favorite Photo and caption. Limit: Each participant may vote for each Photo one (1) time per day during the Voting Phase. The ten (10) Finalists that receive the highest number of votes during the Voting Phase will be will put before the judges to decide the winner of the £3,000 (GBP) Trailfinders Gift Card, subject to Sponsor verification. In case of a tie, the Sponsor, in its sole discretion, will select the finalists based on an application of the Judging Criteria.

Judging Phase (Grand Prize): During the Judging Phase, judges determined by Sponsor (including an independent judge) in its sole discretion will select the Grand Prize Winner from the ten (10) Finalists. The finalists will be the top 10 entries at the end of the public vote, based on highest number of public votes. See details of voting phase below.

Judges (including an independent judge) will judge the entries based on creativity, originality, artistic ability and staging. Choice of winners will be at the sole discretion of the judges.

7. Winner Requirements: Winner requirements are set forth below. Potential Weekly Prize winners will be notified by email on a weekly basis. Weekly Prize winners will be announced on the Clarks Shoes Facebook page, on a weekly basis or once a response has been received by the Sponsor, from the winner, acknowledging the email informing them that they have won If a potential Weekly Prize winner cannot be contacted within 7 days or prize is returned as undeliverable, the winner will be disqualified and will forfeit the prize.

Potential Grand Prize winners will be notified by email on or around October 27, 2010. If a potential Grand Prize winner cannot be contacted within 28 days or prize is returned as undeliverable, the winner will be disqualified and will forfeit the prize. If a potential Competition Grand or Weekly Prize winner is disqualified for any reason, the entrant whose Photo received the next highest number of votes during the Voting Phase will be deemed the potential winner. Only three (3) alternate winners will be selected through this process, after which the applicable prize will remain un-awarded.

For all prize winners: Acceptance of any prize shall constitute and signify the winner’s agreement and consent that the Sponsor may use the winner’s name, city, likeness, Photo and/or prize information in connection with the Competition, worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.

8. Prizes: Prizes for the Photo Competition are set out below.
Weekly Prizes: Each week up to 7 shoe related prizes up to the value of £50 each (GBP) will be awarded. For UK residents this will be in the form of a £50 offline Clarks voucher to be spent in a UK Clarks shop. For overseas winners the prize will be a choice of a pair of shoes from Clarks.co.uk, up to the value of £50, which will then be dispatched free of charge to an address of their choice. Once prizes are dispatched to overseas customers, they are non-returnable so style and size choice must be clearly stated by the winner when initially requested. (Approximate Retail Value: £50 each day). Each entrant can only win the Weekly Prize once throughout the entire campaign. The judges reserve the right not to award a Weekly Prize should there be no entries sufficiently fulfilling the judging criteria.

Gift Cards are redeemable against Trailfinders products and services paid direct to Trailfinders at any of Trailfinders UK travel centres. They cannot be exchanged for cash or used for the purchase of travellers cheques or foreign exchange. Any unused credit will remain on the card and can be used towards payment of future travels. Lost or stolen cards will be replaced at a cost of £100 or 10% whichever is the greater. Gift Cards are valid indefinitely. Gift Cards will only be protected by ABTA when exchanged for travel arrangements at Trailfinders. Sterling cards are not redeemable in Trailfinders Ireland or Australia travel centres.

Any travel booked or purchases made with the Gift Card shall be subject to the separate terms and conditions of Trailfinders and any other relevant third parties.
